You broke the rules, you ingnoramus. The Rules WERE your warning.
Maybe learn your history. Maybe know what was going on during that time period. Do what I did and visit those camps. Smell the burned flesh. See the piles of clothes and human hair. Talk to a relative who survived the death marches at Auschwitz, but who's entire family was wiped out by hate.
Don't feed us a line that you were using the ancient symbol. You know what it means and you know what it stands for. You were warned by the Offensive Emblems policy. You broke it, and your racist self doesn't get to make hateful emblems any more.

If it was just for an emblem then all that you would have been banned from is the emblem editor. Ignorance is NOT an excuse for what you have done. It clearly stats in the security enforcement policy to NOT make such emblems, as well as the actual XBOX Live code of conduct. Here are the links with snippits for review.
Any user who creates an emblem with sexually gratuitous images, racially offensive material or foul language is subject to penalty.
- Minor offense: User will be temporarily banned from using the Emblem Editor, and all emblems will be reset to default.
- Extreme or repeat offenses: User will be permanently banned from using the Emblem Editor, and all emblems will be reset to default.
- Don't create a gamertag, profile content, Avatar action, Avatar content, or in-game content that other users may be offended by. This includes, without limitation, anything related to or suggestive of: profane words/phrases, topics or content of a sexual nature, hate speech (including but not limited to racial, ethnic, or religious slurs), illegal drugs/controlled substances, or illegal activities.
- Don't create a gamertag, profile content, Avatar action, Avatar content, or in-game content that references controversial religious topics, notorious people, organizations, or sensitive current or historical events that may be considered inappropriate.
